The Court of Instruction nº 47 of Madrid has decided this February 12, 2026 not to consider valid the withdrawal of the private prosecution filed by Elisa Mouliaá, representative of the Association for the Integral Defense of Victims of Specialized Crime. In this way, the prosecution continues in the proceedings for alleged sexual assaults against Iñigo Errejón.
The court has rejected the dismissal requested by the defendant, as the waiver of the private prosecution was not ratified with the signature of a lawyer and court representative, an indispensable requirement according to the Law of Criminal Procedure. Consequently, Errejón Galván must appear on February 17 at 10:00 AM, through his legal representation, to be summoned and notified of the Order for the Opening of Oral Trial, which will mark the beginning of the trial phase in this proceeding.
The car signed by Judge Adolfo Carretero establishes that against this resolution there is a motion for reconsideration within a period of three days.
