The victims of the Adamuz case have decided to take another step in their legal battle and have hired Antonio Benítez, a lawyer with experience in the case of the Angrois railway accident, to prepare a lawsuit before the European Court of Human Rights (ECHR), based in Strasbourg. Angrois, the serious railway accident that occurred in Galicia in 2013 causing 80 deaths, is currently under examination in European instances.
The victims consider that in Spain have not obtained a satisfactory judicial response, which is why they resort to the European route alleging violation of fundamental rights. Among their arguments, they maintain that an effective investigation nor adequate reparation has not been guaranteed.
“The objective is for it to be recognized that there has been a lack of effective judicial protection”, state the affected parties, who insist that going to Strasbourg represents “the last opportunity” for their case to be heard in depth.
The European Court of Human Rights examines this type of claims when internal remedies have been exhausted in the member States. In this case, the legal strategy will focus on demonstrating possible breaches of the European Convention on Human Rights by the Spanish State.
The movement of the victims of the Adamuz case occurs in a context in which other processes, such as that of Angrois, continue their course in international instances, which reinforces the expectation that the European court may rule on possible deficiencies in judicial or administrative action.
Awaiting the admission of the lawsuit for processing, the affected parties emphasize that their objective is not only to obtain compensation, but also that responsibilities be cleared and similar situations be avoided in the future.
