La Audiencia Nacional condemns Villarejo: three and a half years in prison for disseminating data from Dina Bousselham's mobile phone

The National Court considers it proven that the former commissioner disseminated information of Pablo Iglesias's former advisor to media and imposes indemnities on him for disclosure of secrets

The Audiencia Nacional has condemned former commissioner José Manuel Villarejo to three and a half years in prison for a crime of revelation of secrets, considering it proven that he accessed and disseminated to media outlets the content of the mobile phone card stolen in November 2015 from Pablo Iglesias' former advisor, Dina Bousselham. The sentence states that the accused acted as a public official and provided private information to third parties.

The court details that the facts date back to the theft of Bousselham's phone while she was shopping at an Ikea establishment in 2015, when part of the device's content ended up being published in various media. The magistrates conclude that Villarejo had access to that information and distributed it, which constitutes a serious violation of the right to privacy.

The judicial resolution also sets economic compensations for those affected: 5,000 euros for Bousselham and 1,000 euros for Pablo Iglesias, then general secretary of Podemos. Likewise, it establishes the subsidiary civil liability of the Administración General del Estado for the actions of the former commissioner in the exercise of his duties.

Nevertheless, the Audiencia Nacional has applied the mitigating circumstance of undue delays, considering the time elapsed since the opening of the separate proceeding in 2017 until its trial. For this reason, the imposed sentence is lower than that requested by the Fiscalía, which amounted to five years of prison, in a case that has once again put the focus on the actions of the former commissioner and his relationship with the dissemination of sensitive information.
