Actress Elisa Mouliaá appeared this morning in the courts of Plaza de Castilla, in Madrid, to testify before the judge investigating her for an alleged crime of slander against the former spokesperson for Sumar, Íñigo Errejón, and who last week had ordered her arrest after she failed to appear for her third summons.
The former spokesperson in Congress for Sumar, Íñigo Errejón, filed a complaint against the actress because she accused him of extorting witnesses in the case for alleged sexual assault. In this context, as the actress did not appear for the last summonses, the judge ordered her arrest because, according to the document, “she has not appeared for the judicial summons that was made to her despite her summons being in legal form and without alleging a just cause that prevents her from doing so.”
The resolution added that the summons has a “marked coercive character” and that, in accordance with article 487 of the Criminal Procedure Law, the order to appear can become detention if the person does not attend or justify a legitimate reason. The judge also maintained that the investigated person has repeatedly expressed “her willingness not to appear” and that this implies a “clear and unequivocal will to evade the action of Justice.”
On the other hand, according to legal sources informed 'EFE', Errejón's defense has asked the magistrate to impose on Mouliaá the obligation to attend court every fifteen days. The former leader of Sumar believes that the actress may have maintained an attitude of possible obstruction of justice.
The request was made at the end of Mouliaá's statement, when Errejón's legal representation requested the adoption of precautionary measures to guarantee her presence in the procedure. Specifically, it requests periodic bi-weekly appearances to ensure her location for future notifications and prevent new breaches of judicial summonses. The investigating judge must now resolve the request through an order in which he decides whether or not to accept the measures requested by the former spokesperson for Sumar.
