OKdiario' and Eduardo Inda condemned for inventing a Civil Guard report pointing to Rubén Sánchez as a member of a harassment network

`OKdiario´ and its director Eduardo Inda, have been condemned by a judge in Seville. This happened after inventing that a report by the Civil Guard points to the general secretary of FACUA-Consumers in Action, Rubén Sánchez, as a member of a supposed harassment network. The sentence dictates that the news incurred in "the attribution to a public authority of a factual conclusion that has no documentary support whatsoever". This obliges them to publish a rectification on the website of the fake news outlet and on its Twitter and Facebook profiles.

Last April, the general secretary of FACUA filed a lawsuit for the right of rectification against Inda and the publishing company of `Okdiario´, Dos Mil Palabras SL, after they refused to publish the text he requested. After this, the sentence obliges them to publish a rectification statement to specify that "The Civil Guard does not say that Mr. Rubén Sánchez García is a member of a harassment network." In addition, the sentence also says that, "we observe an essential discrepancy between the headline and the body of the news, because indeed placing Mr. Rubén Sánchez as a member of a harassment organization to later, entering the body of the news and in one of its paragraphs, state that, to date, no evidence has been found directly linking Rubén to the investigation carried out."

The judge warned Inda's lawyer in his response to the lawsuit that "It is not a value judgment or opinion, but the attribution to a public authority of a factual conclusion that has no documentary support whatsoever. It would be different if the aforementioned headline contained a journalistic assessment, expression or opinion, but the act of attributing said statement to the Civil Guard converts the content of the headline into a fact susceptible to rectification".

This was not all, as the fake news published by `Okdiario´ was reproduced by three other digital media outlets. Mediterráneo Digital, El Correo de Pozuelo and La Gaceta de la Iberosfera, edited by the Disenso Foundation, chaired by the leader of Vox, Santiago Abascal. However, the directors of these three publications did attend to the rectification requests sent to them by Rubén Sánchez. With this, Sánchez has already won five sentences against Inda and Okdiario as a result of three rectification lawsuits filed against the digital director and his director.
