Puigdemont lashes out at the Court of Auditors after it questioned the application of the amnesty: "It consciously disobeys" the CJEU

The struggle for the application of the amnesty law adds a new chapter. The former president of the Generalitat Carles Puigdemont had already taken his criticisms to Brussels, considering that Spain was not correctly applying the criteria set by the Court of Justice of the European Union (CJEU) on the norm. This Wednesday, the leader of Junts has lashed out at a Spanish institution, in this case the Court of Accounts, after the body questioned whether the measure of grace can be applied to some thirty former senior officials of the Government indicted for expenses linked to the 'procés'.

In an article published on the social network 'X' under the title "Will the EU tolerate in Madrid what it demanded from Warsaw?", Puigdemont has accused the Court of Accounts of acting against the criteria set by the Court of Justice of the European Union (CJEU) and has considered that the provision implies a reopening of a matter that, in his opinion, should already be resolved.

"It consciously disobeys the European ruling and orders to reopen what Europe says should have already been closed," said the former Catalan president, who described the auditing body's action as a "challenge" to European justice.

Puigdemont compared the actions of the Court of Accounts with the conflicts that the European Union maintained with the Eurosceptic governments of Poland and Hungary over compliance with European resolutions. The former Catalan president warned that, if Brussels allows a European ruling to be treated differently depending on the country affected, it would be sending a contradictory message about the application of community law. "If what was demanded of Warsaw is tolerated in Madrid, the European Commission would be certifying that European rulings are complied with or not depending on who the accused is," he pointed out.

Criticism of the counselor who signed the order

In addition, Puigdemont directed his criticism against the counselor of the Second Department of Adjudication of the Court of Accounts, Elena Hernáez Salguero, who signed the order that opened the debate on the application of the amnesty in this case. The former Catalan president went so far as to call her "a candidate for prevarication" and accused the magistrate of having been carried away by the "jingoistic euphoria of these days," in reference to the decision adopted by the auditing body.

Puigdemont's defense asks Brussels to intervene

According to 'Cadena SER', Carles Puigdemont's defense submitted an 86-page document to the European Commission requesting action from Brussels regarding the Court of Accounts' actions in the case concerning expenses linked to the referendum of October 1, 2017.

In the document, lawyer Gonzalo Boye argues that the auditing body's decision to open a new ten-day period to submit allegations means, in his opinion, delaying the resolution on the application of the amnesty law. The defense considers that this action contradicts the pronouncement of the Court of Justice of the European Union (CJEU) and has conveyed its complaints to both the European Commission and the European court itself. In addition, the document demands that the amnesty law be applied directly and argues that the Luxembourg ruling already indicated that the measure adopted by the Court of Accounts was not necessary.
