The Prosecutor's Office gets underway due to the situation of minors in Ceuta, setting a decree with guidelines for its prosecutors

Due to the situation being experienced in Ceuta with minors, the State Attorney General's Office has issued a decree with guidelines for action for delegated prosecutors in the territories regarding the processes of distributing unaccompanied foreign minors and states that autonomies should be notified to put obstacles to the reception of those who by law would correspond to them, recalling "the possible responsibilities that could be deduced" in case of non-compliance.

Said decree is addressed to the delegated prosecutors in matters of minors whose departments are affected by the relocation of these children and adolescents, whether they are at the place of departure or in the destination region, to "ensure their well-being and adequately guarantee their protection," since the "superior vigilance and control of the rights of the child must be exercised by the competent prosecutor."

As also established, the prosecutor of the region from which the minors are to depart must communicate to their counterpart in the destination location, indicating expressly whether the age determination files have already been completed or are in process. Based on this, the prosecutor in the destination location must open an administrative file to monitor that the autonomous community "provides adequate reception and fulfills its duty to guarantee the necessary immediate attention and, where appropriate, protection of those through the adoption of appropriate measures."
