The Prosecutor's Office requests nine years of disqualification for Jácome for being paid as mayor and maintaining his businesses

The Public Prosecutor's Office accuses the famous councilor of Ourense of allegedly receiving his salary with exclusive dedication while exploiting Auria TV and other private activities without requesting compatibility from the plenary session

The Provincial Prosecutor's Office of Ourense has requested the opening of an oral trial against the mayor of Ourense, Gonzalo Pérez Jácome, for an alleged crime of administrative prevarication. The Public Prosecutor's Office requests for the leader of Democracia Ourensana a nine-year special disqualification penalty for public employment or office for having collected his salary as mayor under an exclusive dedication regime while maintaining private activities without the authorization of the municipal plenary.

The indictment focuses on the income that Jácome would have made compatible since his arrival at the Mayor's Office in June 2019. According to the Prosecutor's Office, the mayor received close to 470,000 euros in public salaries until November 2025, while between 2019 and 2024 he received 787,687.93 euros for private activities. The main source of these incomes was Auria TV, a local television station of which the mayor is listed as owner and sole responsible, although the prosecutor also mentions other businesses and a real estate operation.

The Public Prosecutor's Office maintains that these activities were not "residual, secondary or marginal" and that the mayor was simultaneously registered in the general regime and in the self-employed regime of the Social Security. The accusation considers that Jácome knew that he needed to request compatibility from the plenary and that he did not do so because he could be forced to choose between the public salary or his private businesses.

One of the points included by the Prosecutor's Office is that the mayor himself requested compatibility in August 2019, barely two months after taking office, but withdrew the petition three days later. The document also recalls that the plenary of the Ourense City Council approved a motion in 2021 to urge him to renounce his salary due to incompatibility, a request that, according to the Public Prosecutor's Office, he did not heed.

Jácome's defense requests the dismissal of the case and the mayor has assured on social media that the accusation is "something baseless that will come to nothing". The Provincial Court of Ourense must still resolve the appeals presented by the parties, while the private prosecution, exercised by former councilman Telmo Ucha, raises the request to eleven and a half years in prison by adding possible crimes of embezzlement and document forgery. If there were a conviction for prevarication before the 2027 municipal elections, Jácome could be out of the electoral race even if the sentence were not final.
