Maricarmen's lawyer denounces that the courts should incorporate "human rights protection" criteria into their decisions: "It could have been avoided"

The eviction of Maricarmen, the 71-year-old woman who was evicted from her home last Wednesday, has once again put the spotlight on the situation of vulnerable people facing eviction procedures. Beatriz Duro, her lawyer, analyzed the case on 'Cuestión de Escaños', ElConstitucional TV's program, where she argued that what happened to her client reflects a problem that affects hundreds of people in Spain every day.

Duro pointed out that, despite the extraordinary media coverage of Maricarmen's case, her situation is not an exception. "This situation occurs daily throughout Spanish territory with hundreds of people being evicted," the lawyer stated during her intervention.

The lawyer focused especially on the legal protection of people in vulnerable situations and questioned whether there is currently a legal mechanism that automatically allows an eviction to be stopped due to these circumstances. "Right now there is no legal umbrella that allows the suspension of evictions for reasons of vulnerability," she assured.

In this regard, Duro also questioned the interpretation that, in her opinion, the courts make of the regulations in this type of procedure. The lawyer believes that the courts apply a "very strict reading of the law" and that, in certain cases, other criteria linked to the protection of fundamental rights are not sufficiently taken into account.

Maricarmen's lawyer specifically pointed out that, from her point of view, the courts should incorporate "human rights protection" criteria into their decisions and also apply international norms that affect this type of situation. As she argued, this issue would have been especially relevant in her client's case.

Duro acknowledged that the judicial decisions adopted in these procedures may be "protected by law," but she argued that this does not mean that there are no other possible interpretations within the legal framework itself.

"It is true that, from my point of view, with the same law in hand, situations like the one we experienced last Wednesday could have been avoided," the lawyer concluded, referring to Maricarmen's eviction.
