The lawyer of Íñigo Errejón, Eva Gimbernart, has requested the Provincial Court of Madrid to expel from the procedure that accuses her client of alleged sexual assault, the complainant, Elisa Mouliaá, due to the “irrevocable nature” when she renounced to continue in the case -the actress resumed the case when the Prosecutor's Office requested Errejón's acquittal- and likewise, has requested the dismissal of the same.
The magistrate has criticized that the decision Mouliaá took to withdraw her accusation must lead "by legal imperative" to the free dismissal of the case. However, this measure was already proposed to the judge in charge of the case, Adolfo Carretero, who refused to dismiss the case.
This move by Errejón's lawyer comes after the defense of Elisa Mouliaá and the second complainant of Íñigo Errejón, confirmed last Friday that the second woman who reported the former Más Madrid member, did not ratify the complaint before the judge. Therefore, the case will be filed away as that necessary step was not taken. However, it is something provisional and at 'Paredes y asociados' they say, "we are trying to ensure it can move forward." For the moment, neither Alfredo Arrién nor Carmen Costa will make statements "by express will of our client".
The lawyer Alfredo Arien -who defends Elisa Mouliaá-, confirmed to 'ElConstitucional' the information about a second complaint for an alleged crime of sexual assault by a woman against the former spokesperson for Sumar, Íñigo Errejón, which occurred in October 2021, according to the complaint to which this newspaper had access.
In the complaint filed before the court, it is stated that Errejón tried "to penetrate her" despite her "active opposition", it has been stressed that "in this case, it is a sexual assault with penetration" and that, furthermore, the leader would have used "force". As they pointed out to 'ElConstitucional.es' from the firm, it was a complaint that was not yet valid because she had to ratify it before the judge in court.
