Judge Arturo Zamarriego has decided to close the investigation opened as a result of the complaint filed by former deputy and former spokesperson for Sumar, Íñigo Errejón, against actress Elisa Mouliaá for an alleged crime of defamation. In this context, legal sources have confirmed the dismissal to 'EFE', information that was advanced by 'El País'.
The magistrate concludes that the statements made by Mouliaá on social networks did not constitute a specific imputation of a criminal act against Errejón, but rather fell within the scope of the actress's "opinions". The complaint originated after Mouliaá published several messages in which she accused the former deputy of having manipulated or conditioned the statements of two witnesses within the procedure in which Errejón is accused of sexually assaulting her.
The actress appeared before Zamarriego on June 24 and denied having acted with the intention of defaming the politician. Upon leaving the courts, she explained that her accusations responded to what she considered at the time had happened. Mouliaá then recounted that she had seen a video corresponding to the statement of one of the witnesses in which he affirmed having had a conversation with Errejón and that the politician had asked him about the planned development of his statement. However, she admitted that she could have been mistaken in her interpretation of the facts.
"I have nothing to retract"
The former spokesperson in the Congress for Sumar, Íñigo Errejón, filed a complaint against the actress because she accused him of extorting witnesses in the case for alleged sexual assault. The actress's lawyer, Elena Vázquez, requested the dismissal of the case, considering that there was no crime because there was no "conscious falsehood, nor intent to defame".
In the previous summons, at the courthouse doors, Errejón expressed that he was going to defend himself against the "defamations and slanders." "Time has put things in their place," he declared.
When this newspaper published these statements, actress Elisa Mouliaá responded to ‘ElConstitucional.es’ through her social media, explaining that she "has a video" that proves her innocence against Íñigo Errejón's defamation complaint and defended: "I have nothing to retract."
"I have nothing to retract from the defamation complaint since the witness himself confesses to having agreed with Errejón in his statement: there is a video that proves it. “I asked Errejón what the plan is”, she wrote.
