The Provincial Court of Madrid has agreed to suspend the prison entry of Francisco Javier Gómez Iglesias, known as 'little Nicolás', for a period of four years. The decision is conditioned on him not committing any crime during that period, according to the judicial resolution accessed by 'laSexta'.
The case is related to the irregular obtaining of information on vehicle registrations through agents of the Municipal Police of Madrid. For these facts, Gómez Iglesias was convicted of crimes linked to improper access to reserved information and for corruption between individuals, with sentences totaling more than two years in prison.
The judicial journey of the case took a turn last March, when the Supreme Court reviewed the initial conviction and significantly reduced the sentence by appreciating extraordinary delays in the processing of the procedure. The reduction nullified part of the sentence previously set by the Madrid Court.
To justify the suspension of prison entry, the magistrates highlight that the events occurred almost twelve years ago and emphasize that, since then, there is no record of 'little Nicolás' having re-offended in criminal behavior. In the court's opinion, this circumstance allows concluding that the risk of recidivism is reduced.
The resolution also focuses on the purpose of reintegration pursued by the penal system. In this sense, it considers that the effective fulfillment of a prison sentence could hinder the process of social integration of the convicted person, which is why it deems it more appropriate to resort to alternative measures that favor their rehabilitation and social adaptation.
