The judge summons Errejón and Mouliaá on Friday after admitting the complaint for alleged slander by the former deputy

Zamarriego appreciates indications of crime in the actress's messages and orders new diligences in the case

The magistrate Arturo Zamarriego, head of the Instruction Section of the Court of First Instance of Madrid, has summoned Íñigo Errejón and actress Elisa Mouliaá to testify next Friday after admitting for processing the complaint for alleged crime of defamation with publicity presented by the former deputy. In his resolution, the judge considers that the described facts “present characteristics that lead to presume the possible existence of a crime”, which justifies the opening of proceedings.

The origin of the judicial conflict dates back to the sexual assault complaint that Mouliaá filed on October 24, 2024, before the Family and Women Unit (UFAM) of the National Police, in which she accused Errejón of an alleged crime against sexual freedom occurred in September 2021. These proceedings were initially instructed by judge Adolfo Carretero, who even charged the former deputy before the Provincial Court of Madrid partially reviewed the case.

The controversy intensified in June 2025, after the declaration as witnesses of a couple residing in Australia who organized the party where, according to the complaint, the events occurred. After these testimonies, made by videoconference, Mouliaá published several messages on the social network X in which he accused Errejón of having “extorted” said witnesses, statements that the politician flatly denies.

The complaint maintains that the actress acted “knowing the falsity” of her statements, a key element for the configuration of the crime of defamation with publicity. Among the messages provided, one is particularly relevant: “Errejón refused to hand over his mobile phone because he had extorted two of my witnesses. Don't invent reality.” 

As part of the documentation, the former deputy has incorporated a report from the Judicial Police that includes WhatsApp conversations between Mouliaá and one of the witnesses, in which the latter assures that she will declare “the truth” and denies having received pressure. Likewise, both witnesses rejected before the judge any attempt at manipulation or influence by Errejón.

Before resorting to the criminal route, the defense of the former leader of Sumar attempted a conciliation act, in which he requested from the actress an indemnity of 10,000 euros in exchange for not filing the complaint, provided she publicly retracted. Mouliaá rejected the proposal, which definitively opened the judicial route.

In his resolution, Magistrate Zamarriego has also agreed to gather new evidence, among them the testimony of the witnesses' statements, the notarial deed provided and the police report.
