Biedma, from investigating judge to witness: Vox requests her testimony before the National Court for the "Leire" case

Abascal's party has requested the National Court to summon judge Beatriz Biedma as a witness, who investigated the brother of the president of the government, David Sánchez, within the framework of a complaint related to the alleged plot being examined in the so-called Leire Díez case. This request, to which Europa Press has had access, is part of the criminal action filed by Santiago Abascal's party against former socialist militant Leire Díez, former judge Luis José Sáenz de Tejada and Jacobo Teijelo, lawyer for the former PSOE Organization Secretary Santos Cerdán, all of whom are charged in the case being investigated by National Court judge Santiago Pedraz.

An alleged strategy seeking to remove the judge

In the brief submitted, Vox argues that the judge would have been the victim of an "organized and continuous strategy", allegedly promoted by people linked to the environment of the Spanish Socialist Workers' Party, with the purpose of removing her from the investigation and even nullifying the open procedure concerning Pedro Sánchez's brother.

The party states that, at the end of 2024, Sáenz de Tejada met with an intermediary of the drug trafficker also known as 'El Gitano' to convey to him that Biedma had to be "given a scare". According to the complaint, months later the former judge would have contacted another group also linked to drug trafficking, the clan of 'los Rochos', to inform them that, if they acted against the judge, the Prosecutor's Office would archive the cases affecting its members, although the group would have rejected the proposal due to distrust.

Coercion, judicial independence and investigated crimes

The party of Santiago Abascal interprets these maneuvers as an attempt to "coerce or intimidate a judge" to achieve her removal from the investigation or, failing that, to "condition, hinder or alter the normal development" of the case affecting David Sánchez, sentenced by the Provincial Court of Badajoz to nine years of disqualification for a crime of prevarication.

For the party, the described facts compromise "judicial independence and the free exercise of jurisdictional power", elements it considers pillars of the democratic rule of law. In this vein, the party argues that its complaint seeks to "fully and autonomously clarify facts" that, due to their object and purpose, transcend other already investigated behaviors and directly affect the integrity of the functioning of the Administration of Justice.

Abascal's party attributes to Leire Díez, Jacobo Teijelo and Luis José Sáenz de Tejada alleged crimes of assault against judicial authority, coercion, discovery and disclosure of secrets, influence peddling and membership in a criminal organization.

In addition, the judge is requested to interrogate the three defendants and to agree to the testimonial declarations of Beatriz Biedma, Cintia Rocho and the intermediary linked to the environment of 'El Gitano'.
