The far-right Vox insists on defying the law and announces that Andalusia will reject the distribution of migrant minors: "That's what we agreed upon"

The far-right Vox has once again announced its intention to block the distribution of migrant minors who arrived in Ceuta. The second vice president of the Junta de Andalucía, Manuel Gavira, assured this Wednesday that the community will oppose any transfer proposed by the central government and used the agreement reached with the PP to justify his position.

"Andalucía, like the rest of the governments where VOX is present, will oppose any distribution of unaccompanied foreign minors proposed by the Sánchez Government. That's what we agreed," Gavira wrote on his X account.

The far-right leader again described the massive entry recorded last week in Ceuta as an "invasion" and demanded that those who crossed the border be returned to Morocco. "And, if they are minors, with their parents," he added.

His message comes just hours after the national leadership of the PP rectified its approach to Santiago Abascal's discourse and publicly defended that autonomous communities must comply with the law.

The party's deputy secretary for Sectoral Coordination, Alma Ezcurra, distanced herself from Vox in an interview on 'Onda Cero'. "We do not express ourselves in those terms and we never will," she stated after Abascal called for "not a single euro" to be allocated to those he called "menas," "illegals," and "invaders."

"We believe that steps must be followed, we believe that the law must be complied with, and the law provides mechanisms to resolve this crisis," Ezcurra defended. The popular leader cited family reunification and the possible return to the protection services of the country of origin, always within established procedures.

Vox shields itself with the pact with the PP

Gavira recalled that the rejection of reception is part of the agreement signed by PP and Vox to form the current Andalusian Government. Point 12 of the document includes a "frontal rejection of the arrival of more illegal immigrants, both adults and minors, to Andalucía".

The pact also establishes that the Board will oppose through "all legal, judicial and political means" any territorial distribution mechanism. This last clarification is relevant because the agreement itself limits the actions of the Andalusian Executive to the channels contemplated by the legal system.

Vox also incorporated into the pact its well-known "No more MENA" campaign, the elaboration of a plan to promote returns and repatriations, and the withdrawal of aid to organizations it accuses of favoring irregular immigration. The party habitually uses the acronym "mena" to reduce to a label children and adolescents who are under the protection of public administrations.

The position announced by Gavira now opens a contradiction within the Andalusian Government. The national leadership of the PP maintains that the communities must comply with the norm, while its coalition partner assures that Andalusia will reject any distribution and presents that refusal as one of the fundamental commitments of the Executive.

A distribution established by law

The territorial distribution of these minors has been regulated in the Immigration Law since the reform approved in March 2025. The norm allows declaring an extraordinary migratory contingency when a territory exceeds three times the ordinary capacity of its protection system.

Once this mechanism is activated, the State determines the destination community of each minor using objective criteria. The resolution must be issued within a maximum of 15 days from its registration and the autonomous communities are obliged to assume guardianship and corresponding care.

Communities can present allegations, appeal decisions, and request precautionary measures before the courts. A political discrepancy or an autonomous pact between two parties lack the capacity to invalidate an obligation contained in a state law.

Gavira's request to generally return minors also clashes with the foreseen procedure. Any repatriation requires prior knowledge of family circumstances, listening to the child when they have sufficient maturity, and gathering reports from protection services and the Public Prosecutor's Office.

Return can only be agreed upon when it responds to the best interest of the minor and there are guarantees to deliver them to their family or to adequate protection services. While these checks are being carried out, the law obliges to provide them with care and make them available to the competent administration.

Vox has chosen to present all minors under the same discourse of "invasion" and announce a general opposition to their reception. The pact with the PP allows it to appeal the distribution through legal channels, but it does not authorize the Junta de Andalucía to disobey a mandatory resolution if it is finally issued.
