The Justice of Seville has decided to prosecute the ultra agitator Vito Quiles after a complaint filed by Rubén Sánchez, general secretary of FACUA, upon finding indications that he spread extremely serious accusations without proof, including crimes such as pederasty, extortion or threats. The investigating judge emphasizes that the analyzed content reflects a clear intent to offend and publicly discredit, violating the right to honor of the plaintiff.

The magistrate María José Moreno Díaz considers that the set of messages and videos analyzed, disseminated on social networks such as X and Telegram, as well as in audiovisual programs, present “clear indications” of constituting crimes of libel and slander. In her order, she details that these are “gratuitous” statements and without evidentiary support, aimed at harming the reputation of the complainant before public opinion.

According to the judicial resolution, Quiles went so far as to attribute extremely serious criminal conduct to Sánchez, such as belonging to extortion schemes, sending death threats, or maintaining links with child exploitation networks, without providing any evidence to support such accusations. The instructor emphasizes that these statements completely exceed the limits of freedom of expression.

The order also states that the origin of these publications would be related to an alleged prior conflict between the two, which the defendant himself linked to the temporary closure of his social media account. However, the judge concludes that this context in no way justifies the use of offensive expressions or the dissemination of unfounded criminal imputations.

Likewise, the magistrate highlights that during his judicial statement, Quiles was not able to demonstrate the veracity of any of the accusations made, which reinforces the existence of a possible intent to defame and slander. This element is key to supporting the continuation of the criminal procedure. Finally, the court has transferred the case to the prosecution so that it may request the opening of an oral trial, a step prior to the case being able to be tried.
