The PSOE requests the reopening of the case against Miguel Ángel Rodríguez for alleged crime of revealing secrets and brand the investigation as "biased"

The PSOE has requested the reopening of the case against the right-hand man of the president of the Community of Madrid, Isabel Díaz Ayuso. Madrid's Court of Instruction number 25 dismissed the complaint against the head of the Presidency cabinet of the Community of Madrid, Miguel Ángel Rodríguez (MAR), who was investigated for a crime of revealing secrets for allegedly having leaked personal data of two journalists from 'ElPaís'. In his last statement, before entering the court, he assured the media that it was "an angry neighbor" who sent him the photograph of the newspaper's journalists. However, minutes later he pointed to Alberto González Amador, Ayuso's partner, as the one who sent him the photos of the two journalists.

In this regard, the socialists, who are acting as popular accusers, according to a document accessed by 'eldiario.es', have appealed the dismissal of the case and have asked the Provincial Court of Madrid to order the reopening of the investigation. The party emphasizes that neither the police officers who identified the journalists nor the person who allegedly took the image testified. As the appeal recalls – transmitted by the aforementioned media – the magistrate had summoned the police officers as witnesses and even later suspended their appearances to assess whether they should appear as investigated, but finally agreed to dismiss the case before resolving that question.

The PSOE also focuses on the statements of Miguel Ángel Rodríguez and Alberto González Amador, who admitted before the court to having deleted the WhatsApp conversation in which, according to their version, the businessman sent Ayuso's chief of staff the photograph of the journalists. The socialists relate this fact to the recent ruling of the Supreme Court that condemned the Attorney General of the State and in which the deletion of messages that could have served to corroborate their account of the facts was questioned.

In fact, the document states that "it will not be trivial to remember that the investigated, as well as Mr. González Amador, insisted on the accusation against the Attorney General of the State, that deleting conversations was suspicious in an accused, since an innocent person does not delete messages when he is pointed out by Justice. Whoever held that opinion has deleted messages when he has been pointed out by Justice."

The popular accusation also questions the documentation later provided by González Amador to support his version. According to the PSOE, it is “confusing and inconsistent” material, composed of screenshots whose authenticity, date, and participants have not been verified. The appeal states that “none of these messages have been cross-referenced nor has their reality, the intervening persons, or their dates been verified.”

Finally, the socialists maintain that the magistrate “has anticipated the closing of the investigation” without having clarified fundamental aspects of the case and denounce an action based on “a biased practice of proceedings, where those aimed at investigating the crime are discarded in favor of others aimed at exculpating the accused,” in reference to Miguel Ángel Rodríguez.
