The far-right Vox announces a lawsuit against Sánchez and Minister Marlaska for the crisis in Ceuta and attributes "collaboration with terrorism" to them

The far-right Vox has decided to take its offensive over the Ceuta crisis to the Supreme Court. The legal coordinator of the far-right party and head of its delegation in the European Parliament, Jorge Buxadé, announced this Monday a lawsuit against the President of the Government, Pedro Sánchez; the Minister of Interior, Fernando Grande-Marlaska, and the Secretary of State for Security, Aina Calvo.

Santiago Abascal's party attributes to them alleged crimes of omissive prevarication, omission of the duty to render aid, negligent homicide and injuries, and collaboration with terrorism for the Executive's response to the massive entry of migrants recorded at the end of July. The most extreme accusation, that linked to terrorism, has been justified by Buxadé based on the "terror" that, he maintains, has been generated among the residents of Ceuta.

The announcement of a lawsuit barely opens the door for the Supreme Court to study its content. It will have to be formally presented, pass the admission examination, and provide sufficient evidence for an investigation to begin. The accusations made by Vox currently lack any judicial backing.

From residents' fear to a terrorism accusation

Criminal legislation requires much more than the existence of alarm or fear among the population. The crime of collaboration requires having facilitated or carried out acts of assistance to a terrorist organization, group, or person, or having cooperated in the commission of any of the crimes included in that chapter of the Penal Code. Vox will have to explain to the magistrates what specific acts it attributes to each member of the Government and with what terrorist organization it supposedly links their conduct.

Buxadé has taken his discourse even further by asserting that Sánchez is "an agent of Morocco" and that the PSOE functions as its "diffusion and communication network" in Spain. These are extremely serious claims for which the far-right leader has also not presented evidence during his press conference.

The party has already used accusations such as reckless homicide and dereliction of duty in previous actions against Sánchez for the management of the DANA storm and the fires. Now it is once again using the Penal Code as an extension of its political strategy while maintaining the term "invasion" to refer to the arrival of migrants in Ceuta.

The treason route needs another 56 deputies

Vox also intends to open a second route against Sánchez for alleged treason and crimes against state security. Article 102 of the Constitution requires that an initiative of this nature be promoted by a quarter of Congress, 88 deputies, and then approved by an absolute majority, set at 176 votes.

Vox's 32 seats are insufficient even to initiate the procedure. Buxadé has demanded that another 56 parliamentarians support the initiative, a support that the far-right still cannot find. Its pressure points mainly to the PP, from which it has demanded "facts" and to which it again demands Vox's entry into Juan Jesús Vivas's government in Ceuta.

Abascal's party also rejects the transfer of migrant minors to the Peninsula to alleviate the care situation in the autonomous city. Buxadé has demanded that all those who entered irregularly, "adults and minors," return to Morocco, even asking that they be put "in line" for their return.

The Immigration Law requires individual study of the situation of minors, listening to them when they have sufficient maturity, gathering reports from protection services and the Public Prosecutor's Office, and guaranteeing their best interest. Repatriation can only be agreed upon through family reunification or when there are adequate services to take charge of their guardianship in the country of destination.

The Council of Ministers is scheduled to approve the declassification of official reports on the Ceuta crisis this Tuesday. The documentation can be consulted starting Wednesday.
