The political scientist Antón Losada has questioned the procedure for obtaining evidence in the case related to the rescue of Plus Ultra Líneas Aéreas, by questioning in Malas Lenguas the legal guarantees of the process of seizing a mobile device.
During his intervention, Losada pointed out that the case is not limited to a possible formal defect, but directly affects the legitimacy of the procedure, raising doubts about the authorization to intercept the phone and the conditions under which said action would have occurred.
The analyst has also questioned which authority would have ordered the intervention of the device and has pointed out the possibility that there was no clear judicial or administrative authorization, which, in his opinion, raises questions about the criteria used in the operation.
Likewise, he criticized that, despite the supposed seriousness of the investigation, the phone owner could have been released after the intervention, as well as the lack of guarantees regarding the integrity of the extracted information, including the possibility of manipulations or cuts in the stored conversations.
Losada concluded that it is not a “formal detail”, but a key issue that affects the legal validity of the procedure and, therefore, the probative value of the messages incorporated into the investigation.
