An employee of the Torrejón de Ardoz City Council allegedly distributed flyers and gifts in a Popular Party tent, during her working hours, within the framework of Alberto Núñez Feijóo's pre-campaign for the general elections on November 29, as 'ElConstitucional.es' has exclusively learned. The events allegedly occurred around 12:00 PM this Thursday, coinciding with Borja Sémper's visit to the Madrid municipality.

According to information gathered by this media outlet, the worker S.L performs duties as Administration Coordinator for the City Council and allegedly participated, during working hours, in the distribution of propaganda material for the party that aims to bring Feijóo to Moncloa on 29N.

The spokesperson for the PP and for the campaign and deputy secretary for Culture and Sports, Borja Sémper, visited Torrejón de Ardoz this Thursday to address the media alongside the mayor, Alejandro Navarro, according to the announcement published by the party itself.

Using municipal personnel to benefit a party can constitute embezzlement

The possible use of a municipal worker to distribute partisan propaganda has a dimension that goes beyond the cost of flyers or gifts. Working time paid for by an Administration is also a public resource susceptible to improper use.

The jurisprudence of the Supreme Court includes within embezzlement the use of municipal employees, during their working hours and with salary paid by the City Council, to perform work for the benefit of private interests. A ruling by the Provincial Court of Madrid in June 2025 expressly includes this doctrine and recalls that the protection of public assets also includes labor paid by the Administration.

Consequently, assigning municipal personnel to carry out propaganda for a party could constitute a crime of embezzlement, depending on the proven circumstances and the applicable criminal modality. It is not essential for a responsible party to personally take public money for this crime to exist.
