Alberto Núñez Feijóo has made the fight against squatting one of the cornerstones of his housing proposal for 29N. In a pre-campaign event held this Wednesday in Seville alongside the president of the Junta de Andalucía, Juanma Moreno, the PP candidate has promised a law that allows eviction in 48 hours and has argued that reinforcing the security of owners will contribute to increasing the rental supply.
"All sensitivity with the citizen who complies and all firmness with the freeloaders," he stated before assuring that, with his Government, "squatters will be out in 48 hours." Feijóo has placed this norm among the three legislative projects he commits to approving in the Council of Ministers during his first hundred days, along with a new Land Law and a reform of the Horizontal Property Law.

The popular leader has maintained that there are "owners with fear" and has resorted to the example of a person who enters a home and presents "a paper of having ordered a pizza," with which, he has affirmed, "no one can remove them for several years." Current legislation allows prosecuting such entries and recovering possession of the property, with different procedures depending on the case.
Complaints decrease and the law already allows action
The Ministry of Interior registered 14,875 known incidents of trespassing and usurpation of properties in 2025, compared to 16,426 in 2024, a decrease of 9.4%. The statistic groups different behaviors and collects incidents known to security forces; it does not allow identifying all these cases with families expelled from their homes nor does it constitute a count of occupied homes. The problem of access, meanwhile, continues to be marked by the rising cost of housing, whose purchase price increased by 12.2% year-on-year in the second quarter of 2026, according to the INE.
Entering another person's dwelling without authorization constitutes a crime of trespassing, regulated in article 202 of the Penal Code. This protection includes the habitual residence and second homes where private life takes place, even if used temporarily. In the face of a flagrant crime, the Police can intervene immediately, provided that the legal conditions are met and there are elements that can prove it.
The peaceful occupation of another's property that does not constitute a dwelling falls under the crime of usurpation of article 245.2, which has a different treatment. A proof of home delivery food does not provide a title to reside there nor does it by itself prevent an eviction. Nor does paying utilities equate to having a rental contract or the owner's authorization. The recovery of the property may require judicial intervention and its duration depends on the evidence and the circumstances of the procedure.
The Public Prosecutor's Office has had instructions since 2020 to request precautionary evictions before the procedure ends, when there are indications of the crime and the requirements that justify the measure are met. In addition, the procedural reform of 2025 incorporated certain cases of home invasion and usurpation into fast-track trials, although peaceful usurpation considered a minor crime retains its specific procedure. These avenues do not ensure an immediate resolution in all cases, but they do allow action without necessarily waiting for a final judgment.
Three projects in one hundred days and one million homes
Feijóo has linked the protection of owners with his diagnosis of the lack of supply. "When the owner feels secure, they rent," he defended, adding that greater availability of flats would allow prices to improve for tenants. His hundred-day commitment refers to the approval of the projects by the Council of Ministers, which would then need to be processed and obtain support in the Cortes to become laws.
In the rental market, he announced tax deductions for owners and tenants who extend their contracts up to three years, with rent increases below the CPI. "This is going to be a contract, a fiscal contract," he said. The proposal seeks to incentivize the continuity of leases through tax advantages, although he did not specify their amount at the event.
For those under 40, the popular candidate has promised guarantees of up to 100% and reductions of 60% in VAT and in the Property Transfer Tax, two taxes that apply to different operations. He also defended his proposal for 'Hucha Hogar Joven' (Young Home Piggy Bank), a savings account for housing with deductions for contributions and exemption from returns. As an example of all his aid, he calculated that a young person who buys a house for 250,000 euros after five years of work could save 25,000 euros in taxes and need 50,000 euros less when formalizing the mortgage; that guarantee, in any case, does not eliminate the obligation to repay the loan.
The announced objective remains to build one million homes during the next legislature, for which it proposes to mobilize land, simplify procedures and establish, as a general rule, positive administrative silence after ninety days. Feijóo has promised to bring together the autonomous communities and city councils to promote the plan and has said that he wants those who are protesting in the streets today to be able to access decent housing at the end of the mandate. "If in four years I come back here, next to the Torre del Oro, and I haven't fulfilled it, don't vote for me," he declared.
