The ultra agitator Vito Quiles sets up a company after FACUA's complaint about his t-shirt business

Rubén Sánchez questions whether the 3,000 euro company seeks to avoid possible fines and denounces that Consumer Affairs still has not responded to the claim filed in July for false discounts and lack of legal information

Rubén Sánchez has once again denounced the commercial practices of ultra agitator Vito Quiles. The general secretary of FACUA-Consumers in Action pointed out this Monday the creation of REVIVALVQ SL, a company with 3,000 euros of capital dedicated to clothing trade, and recalled the claim that the association filed in July against the 'Revival' t-shirt store. "It advertises false sales and omits basic legal information," he states on X, where he assures that he has not yet received a response from Consumer Affairs.

The company is listed in the Official Gazette of the Mercantile Registry (BORME) of September 11. The announcement includes the start of operations and registration on September 4, 2026, a capital of 3,000 euros, and the appointment of Vito Zoppellari Quiles as sole administrator. Its corporate purpose is the retail trade of clothing and it is domiciled in Madrid. The constitution occurred after FACUA denounced the operating conditions of the store.

Sánchez questions the purpose of this business move. "A way to evade personal fines for irregularities in his t-shirt business?", he asks in his publication. The registry certifies the existence of the company and who administers it, but it does not prove that it was constituted to avoid sanctions. This suspicion belongs to the FACUA leader, who demands an administrative response to the reported facts.

The creation of a company also does not automatically transfer to that company the responsibility for possible previous infractions. The Law on the Legal Regime of the Public Sector establishes that administrative sanctions must be directed against the natural or legal persons responsible for the facts. Determining who operated the store when the reported behaviors occurred is part of the checks that would correspond to the Administration.

A Reported Store

FACUA announced its complaint on July 10, almost three months before this new message. It directed it to the General Directorate of Consumer Affairs, the Secretary of State for Digitalization, the Spanish Data Protection Agency, and the General Directorate of Commerce, Consumer Affairs and Services of the Community of Madrid. The association pointed out problems in the discounts and in the information provided to 'Revival' buyers.

As the organization explained then, the store had just opened and presented t-shirts with prices crossed out as if they had previously been for sale for a higher amount. FACUA maintained that these previous prices were invented. Its complaint therefore questioned the savings announced to the buyer, by comparing the launch price with another that, according to the association, had never been applied.

The Retail Trade Regulation Law sets a specific reference for announcing discounts. As a general rule, the previous price must be the lowest applied to the same product during the preceding thirty days. Article 20 expressly contemplates the case of items put up for sale for the first time. FACUA's claim was based on the fact that the t-shirts were promoted with a discount on a non-existent previous price.

The complaint also pointed out that the website did not identify the owner or provide their tax identification. According to FACUA, information was missing about the legal guarantee of the products and about the right of withdrawal, which allows a distance purchase to be returned under the conditions provided by the regulations. These are data that the consumer needs to know who they are buying from and how to complain.

The association added deficiencies regarding the processing of personal data collected through the contact form. According to its review, the privacy policy was only accessible during the purchase process, before entering shipping and payment methods. Sánchez now insists on the lack of response to the complaint; its publication does not announce a fine or an administrative resolution that has accredited the infractions.

Five legal actions

The commercial complaint adds to a judicial confrontation that began in 2022. Last week, Sánchez announced that a court in Seville had admitted his fifth legal action against Quiles. This is a civil lawsuit for publications in which the ultra agitator attributed fraud, document forgery, and tax evasion to him. 'ElConstitucional.es' reported on that claim after accessing the brief, which requests 60,000 euros for moral damages, the removal of the messages, and the dissemination of a possible conviction.

This lawsuit is added to two criminal complaints, a previous claim for violation of honor, and another for rectification. The latter arose after 'Combativos', Quiles' platform, failed to publish the response sent by Sánchez to accusations about an alleged fake invoice and a non-existent company. The general secretary of FACUA maintained that his work for UGT had been carried out as a freelancer and submitted judicial resolutions to refute the imputations.

The proceedings continue after the departure of Juango Ospina, the lawyer who had publicly appeared in Quiles' defense. As this newspaper published in September, Ospina left active practice to assume a diplomatic responsibility for Colombia in Brussels. In the first criminal case against Sánchez, he did not appear, despite having announced actions against the prosecution.

In that procedure, Sánchez's private prosecution requests nine years in prison for three continuous crimes of slander, with the aggravating circumstance of ideological hatred, in addition to 60,000 euros in compensation and disqualification from journalistic activities during the requested sentence. This is a request from the prosecution pending judicial decision, different from both the new civil lawsuit and the administrative complaint for the t-shirt store.
