Alternativa Ferroviaria has filed a complaint against the Minister of Transport and Sustainable Mobility, Óscar Puente, before the Supreme Court Prosecutor's Office for the alleged dissemination of Adif recordings related to the Urda (Toledo) railway accident, which occurred on October 28.

The union requests an investigation into whether the events could constitute a crime of disclosure of secrets or classified information and, if applicable, of procedural actions declared secret, according to the complaint accessed by Europa Press.

Puente's statements on railway communications

The organization places the origin of the complaint in the appearance the minister made on the same day of the accident from the Adif Control Center in Atocha. During his intervention before the media, Puente referred to the recordings of railway communications linked to the accident and stated: "We have listened to some recordings that are extracted from the communications."

In that same appearance, the head of Transport explained that it had been possible to hear how instructions were given to other trains: "We have been able to hear... how instructions are given to the other trains." He also alluded to an indication that, according to his account, would have been corrected by one of the train drivers when warning that it was not possible to circulate at normal speed, but "by sight."

The union asks to clarify the confidential nature of the audios

Based on these statements, Alternativa Ferroviaria maintains that the minister may have made public the content of operational communications recorded by Adif, including instructions transmitted from the Atocha Regulation and Control Center. The organization considers that these records are relevant to clarify the circumstances of the accident and possible responsibilities.

The complaint demands that it be determined whether Puente was aware of the alleged confidential nature of the communications by virtue of his position and whether the recordings he mentioned were already part of the judicial proceedings declared secret by the judge of Orgaz (Toledo), in charge of instructing the investigation. The Prosecutor's Office must assess the facts and decide whether to initiate proceedings.
