Errejón appeals the dismissal of his lawsuit against Mouliaá and maintains that the actress sought to damage his reputation

Former deputy Íñigo Errejón has appealed the dismissal of his lawsuit against Elisa Mouliaá and has decided to transfer the case to the Provincial Court of Madrid. The former deputy has appealed the decision of Judge Arturo Zamarriego to close the investigation into the accusations of slander he directed against the actress and demands that the case be reopened.

The appeal, filed by Errejón's lawyer, Eva Gimbernat, argues that Mouliaá's social media posts were not simple opinions, as the magistrate concluded, but rather statements that could have criminal relevance. The former deputy's representation also argues that the actress acted with the purpose of harming his reputation and questioning his credibility.

According to 'EFE', the document attributes to Mouliaá an express desire to “defame, undermine the honor, destroy the credibility and honorability” of Errejón. With these arguments, his defense asks the Provincial Court to annul the dismissal agreed by Zamarriego and allow the proceedings to continue.

The origin of the procedure lies in several messages published by Mouliaá on social media, in which she accused Errejón of having extorted or conditioned two witnesses in the case in which the former Sumar leader is accused of having sexually assaulted her. This investigation is being processed independently before another judicial body.

Last month, Zamarriego decided to end the proceedings, considering that the actress's statements did not constitute a concrete accusation of a crime attributable to Errejón. The magistrate understood that her publications were in the realm of “opinions” and, therefore, did not fit the crime of slander.

The decision came after Mouliaá appeared before the judge on June 24 to answer for the lawsuit. During her statement, she denied having intended to harm Errejón and explained that her accusations were in response to the interpretation she had made of certain evidence in the case for the alleged sexual assault.

Specifically, the actress claimed to have seen a video of one of the witnesses' statements in which he recounted a conversation with Errejón and assured that the then deputy had asked him about the development of his statement. Mouliaá admitted, however, that her interpretation of that conversation might not have been correct.

The actress's defense had previously requested the dismissal of the procedure, understanding that there was no criminal conduct. Her lawyer, Elena Vázquez, maintained that there was no "conscious falsehood, nor intent to defame." Mouliaá also publicly defended that she had no reason to retract her accusations.

"I have nothing to retract," the actress assured after the lawsuit became known. Mouliaá even claimed that she had a video that, in her opinion, would support her version and pointed out that in it one of the witnesses admitted having spoken with Errejón about his statement: "I asked Errejón what the plan was," she wrote.

Now it will be the Provincial Court of Madrid that must rule on the appeal filed by Errejón's defense and determine whether to maintain the dismissal agreed by the instructor or consider it necessary to continue with the proceedings.
